Our Approach

In order for Capital Litigation Funding to consider taking on a case it must be:

  • Financially viable for us to participate We will generally only consider cases involving amounts of £250,000 and above
  • Have a good chance of success After having made a careful assessment of the facts and the law we have to be convinced that there are good prospects for the case and the risks are acceptable
  • The defendant must be in a position to settle the claim It goes without saying that the defendant must have the necessary funds/assets to pay any award sought plus costs

How to move forward with an application

  • The application process starts with an initial confidential discussion with Capital Litigation Funding

  • If Capital Litigation Funding felt your case had merit we would request that you forward further details of your claim/action for a detailed assessment stage

  • Capital Litigation Funding would undertake a detailed assessment of your case which may involve the input of specialist third parties and obtaining counsels opinion.  There would be no cost involved for the client and all fees for the assessment stage would be borne by Capital Litigation Funding. 

  • Based on the assessment stage Capital Litigation Funding would make a decision whether to take on the case and the level of return required,  though in some cases it may be necessary to undertake extended due diligence including seeking clarification from the intended Defendants. 

  • The amount Capital Litigation Funding would look to retain will depend on a number of factors including the quantum of damages/recoverable sums, other remedies sought and the complexity of the case.

  • Capital Litigation Funding will outline the level of return required, approach to be taken with the case and any other relevant issues with the client.  If the client is agreeable to the approach and terms of engagement with Capital Litigation Funding then contracts will be drawn and signed.

  • Once Capital Litigation Funding has been engaged we will maintain regular contact with the client and the legal team ensuring everything is progressing in accordance with the agreed strategy and plan.

  • At the successful outcome of the claim/action the representing solicitors will deduct all agreed amounts and remit the balance to the client or Insolvency Practitioner.
